Neighbors can and will impact your quality of life; good neighbors invite you to barbecues, provide an extra set of hands to help out, and let you enjoy your own home in peace and quiet. However, living next door to a dog barking, or overgrown bushes, or unkempt lawn, or other problematic issues will quickly convert you to believing the old saying "Good fences make good neighbors".
Fences are the biggest dispute most of us will experience in our home ownership years. Disagreements over boundary lines may be the most complicated legal problem to solve. In early September I received a call from a client asking me for advice. His neighbor was building a fence and he thinks it is on his property. My first advice, notify the neighbor immediately (verbally & in writing). Don’t wait, once the fence has been completed, you could be giving up your right to that land. Neighbors can agree to a certain imaginary line or object that will serve as the boundary between the properties. Then you both can have a lawyer draw up a document to be signed and recorded. Please note, I am not an attorney so ask an attorney for advice on this topic. This blog is to bring this situation to your attention prior to spring when you or your neighbor start working on that new fence!
